ACCEPTABLE USE POLICY (AUP)

1. Purpose

This Acceptable Use Policy (“AUP”) governs the permitted and prohibited use of the SmartCascade platform and related services (“Service”).

This AUP forms part of the SmartCascade Terms of Service. By using the Service, you agree to comply with this AUP.

SmartCascade provides infrastructure technology only. We do not monitor campaigns by default but reserve the right to investigate violations.

2. General Principle

You may use the Service only for lawful, legitimate, and ethical business purposes.

You are solely responsible for:

• All traffic routed through the platform
• All campaigns and creatives
• All integrations and API connections
• Compliance with applicable laws
• Actions of your affiliates, publishers, advertisers, and partners

3. Strictly Prohibited Activities

You may not use SmartCascade to facilitate, promote, distribute, or support:

3.1 Illegal Activities

• Any activity that violates applicable laws or regulations
• Fraudulent schemes
• Money laundering
• Terrorist financing
• Sanctions evasion

3.2 Fraud and Traffic Manipulation

• Click fraud
• Conversion fraud
• Incentivized fraud without disclosure
• Bot traffic
• Artificial traffic generation
• Spoofed referrers
• Manipulated attribution
• Cookie stuffing
• Pixel stuffing
• Ad stacking
• Hidden redirects
• Domain spoofing

3.3 Malware and Harmful Code

• Viruses
• Trojan horses
• Spyware
• Adware
• Cryptominers
• Malicious scripts
• Forced downloads
• Exploit kits

3.4 Deceptive Practices

• Phishing
• Fake offers
• Misleading landing pages
• False endorsements
• Impersonation
• Cloaking to misrepresent content

3.5 Intellectual Property Infringement

• Unauthorized use of trademarks
• Copyright violations
• Pirated content
• Unauthorized brand bidding where prohibited

3.6 Privacy Violations

• Collection of personal data without lawful basis
• Failure to obtain required consent
• Unlawful cross-border transfers
• Use of unlawfully obtained data
• Unauthorized data scraping

3.7 Regulated or High-Risk Content (Without Prior Written Approval)

The following categories require explicit written approval from SmartCascade:

• Gambling and betting
• Adult content
• Crypto-related financial services
• Financial trading products
• Loan or credit offers
• Health supplements
• Pharmaceutical products
• Sweepstakes and lead generation offers
• Political advertising

We reserve the right to deny approval at our sole discretion.

3.8 Network Abuse

• Attempting to access other accounts
• Circumventing system controls
• Reverse engineering the platform
• Load testing without authorization
• Distributed denial-of-service (DDoS)
• Interfering with platform integrity

4. Traffic Quality Requirements

All traffic routed through SmartCascade must:

• Originate from legitimate sources
• Be lawfully acquired
• Be transparently represented
• Not mislead end users
• Not violate third-party platform rules

You are responsible for monitoring affiliate and publisher behavior.

SmartCascade does not assume responsibility for traffic quality.

5. Data Protection Obligations

You must:

• Provide legally compliant privacy notices
• Obtain required user consent for tracking
• Maintain appropriate security safeguards
• Execute required data processing agreements with partners
• Respond to data subject rights requests

You may not use SmartCascade to process unlawfully collected personal data.

6. Monitoring and Enforcement

SmartCascade reserves the right to:

• Investigate suspected violations
• Request documentation or clarification
• Suspend routing
• Freeze accounts
• Remove campaigns
• Terminate accounts
• Report unlawful conduct to authorities

We may take action without prior notice where necessary to protect platform integrity or comply with legal obligations.

7. Cooperation Requirement

You agree to:

• Cooperate with investigations
• Provide requested information promptly
• Implement corrective measures where required

Failure to cooperate may result in immediate suspension or termination.

8. Indemnification

You agree to indemnify and hold harmless SmartCascade from any claims, damages, regulatory fines, losses, or liabilities arising from:

• Your violation of this AUP
• Traffic fraud or deceptive practices
• Data protection violations
• Intellectual property infringement
• Illegal advertising activity

9. No Duty to Monitor

SmartCascade is not obligated to monitor campaigns, traffic, or user conduct.

However, we reserve the right to implement fraud detection, anomaly detection, and risk scoring mechanisms to protect the platform.

10. Updates to This Policy

We may update this AUP at any time.

Continued use of the Service constitutes acceptance of the revised policy.
